*DON’T ERASE 132 YEARS: STAND UP BEFORE HISTORY IS STOLEN*
✍️ _Written by Nithian (USM 1982-1986)_
> “O you who believe, stand firmly for justice, as witnesses to Allah, even if it be against yourselves, your parents, or your relatives.” *— Surah An-Nisa (4:135), The Holy Quran*
This verse calls all believers—not just Muslims—to uphold justice, even when it’s inconvenient, uncomfortable, or goes against powerful interests. It also protects the rights of non-Muslims, minority communities, and religious institutions from being wronged.
*So ask yourself* :
Will we stay silent while a 132-year-old temple in Jalan Masjid India is quietly wiped out?
*What Happened* ?
The temple, which has stood for 132 years, is now under threat. The land was recently sold to Jakel Sdn. Bhd., with DBKL’s approval, without informing the temple committee. No warning. No consultation. No justice.
This is not just unethical—it may be illegal.
*What the Law Says:*
1️⃣ National Land Code 1965 – Section 341(2)
If someone has been occupying land peacefully and openly for more than 12 years, and no one challenges them, the legal owner loses the right to claim it back.
> This temple has been there for 132 years. That’s 11 times the legal threshold.
2️⃣ No One Was Dispossessed (Legal principle from LRA 2002, UK)
Dispossession means someone was pushed off the land. Here, the temple didn’t take the land from anyone. The “new owners” came after the temple had long established itself.
3️⃣ Duty of Authorities – DBKL’s Role
DBKL had a moral and legal responsibility to notify the temple occupants. They failed. Worse—they approved the registration quietly, despite knowing the temple was there.
> This is potentially fraud, or at the very least, a serious administrative failure.
*Why This Matters to Everyone*
This isn’t just about Hindus or a single temple. It’s about whether anyone’s sacred place, heritage site, or long-standing community can be taken away with no due process.
If this can happen to one group, it can happen to any of us.
*What Can Be Done Now* :
✅ Demand a legal injunction to stop any development ✅ File a court case to defend the temple’s rights under the 12-year rule ✅ Speak out. Share this post. Spread the truth.
Justice is not a religious idea. It's a human one.
When we protect the vulnerable, we honor our faith, our country, and our conscience.
✊ _Let us all—Muslims, Hindus, Christians, Buddhists, and others—stand together before more sacred spaces are stolen in silence_ .
I do not aim to please anyone. This is my blog, there is no blog like this. I am not mainstream. Read my disclaimer before posting comments and threatening me. Not to worry, I will not quiver in my boots. If you are not happy, no problem, just take a hike!!
