The MAF pensions are governed by:
a. Article 41 & 137 of the Federal Constitution.
b. Sections 157 & 187 of the Armed Forces Act 1972.
c. P.U.(A) 123 dtd 1982.
There are many other case laws which I had made as "Stare Decisis" in my case which I had won at High Court last year which clearly shows that, the High Court, Court of Appeal and Federal Court had made decisions to say that the AFC have absolute power over Armed Forces Personnels on 3 matters spelled out under Article Article 137 of the FC.
In Article 139 FC, it is also clearly stated that the General Public Service Commission has no jurisdiction over the AFC.
However ini Aminah case, we use the decision of the Federal Court that Article 147 FC, should be applied to the Armed Forces too.
My claims in High Court is not the same what Aminah claimed.
I claimed that the AFC failed to adjust our pensions when the MAF had a pay rise. This was against our pension regulations as I mention above. I have many other arguments over the recent SSPA decisions but many of the Veteran Associations are more egar on the 8%(of the 15%) promised but ignore on the high court decision I won.
We will be in the loosing end and be cheated in broad daylight!
