Assalammualaikum kepada semua Veteran ATM. Saya harap penulisan saya tentang penerangan bagi kedua Mahkamah ini biarlah buat kali terakhir. Sebenarnya idea untuk membawa kes ini ke Mahkamah Timbangtara adalah idea saya dan bukannya idea LtKmr Zin atau LtKmr Rafique.
Saya pada mulanya ( April 2022) mencadangkan isu pencen ATM di bawa ke Mahkamah Timbangtara kerana saya dapati process Timbangtara atau rundingan adalah lebih mudah dan lebih pantas dari process Mahkamah Awam. Ini kerana saya telah mengambil bahagian untuk mencabar keputusan kerajaan menggubal dasar Program Imunisasi COVID-19 Kebangsaan (PICK). Walaupun kami menang di Mahkamah Timbang Tara, Mahkamah Tinggi telah memutuakan bahawa Mahkamah Timbangtara tiada bidang kuasa untuk mendaftarkan award semakan kehakiman.
Oleh kerana kes tuntutan pencen ini melibatkan semakan kehakiman, tafsiran akta Parlimen dan tafsiran Perlembagaan Persekutuan, saya membuat keputusan untuk tidak membawa kes tuntutan pencen ATM ke Mahkamah Timbangtara dan sebaliknya membawanya ke mahkamah Tinggi Awam. Pada pendapat saya ianya akan lebih menjimatkan kos dan masa kerana akhirnya suka tak suka kes ini akan ke mahkamah Tinggi juga dan mungkin ke Mahkamah Persekutuan.
LtKmr Zin dan LtKmr Rafique telah menghasut dan keliru kan sebahagian besar veteran dengan memfitnah saya dengan berbagai tomahan. Ramai juga mereka (veteran) yang ikut kedua orang ini tidak tahu yang saya tidak berada dalam PPPM. Saya tidak pernah menghalang sesiap yang hendak bersama PPPM kerana niat saya adalah 100% fisabilillah untuk veteran. Tetapi lama kelamaan saya dapati tindakan Zin dan Rafique sudah melampau dan tidak mengikut prinsip undang-undang yang sebenar.
