Malaysiakini : Ismail Sabri Yaakob contended that incumbent Klang MP Charles
Santiagoās legal challenge over the 15th general election is academic as
Parliament has already been dissolved.
In an affidavit filed at
the High Court in Kuala Lumpur yesterday afternoon, the caretaker prime
minister also claimed that the Yang di-Pertuan Agong has already sought
for GE15 to be held before the onset of the annual monsoon season this
year.
The affidavit by the incumbent Bera MP as well as the
government was in support of their application to nullify the DAP
lawmakerās legal challenge against the national polls being held this
year.
On Tuesday last week, Charles filed the civil action, citing concerns over flood risks to voters if GE15 is held during the monsoon season. Then, a few days later, around midday last Friday, the three
defendants - Ismail Sabri, the government, and the Election Commission
(EC) - entered appearance in the lawsuit in order to respond to it. A few hours later that same day, the trio filed a formal application to strike out the civil action.
According to a copy of the affidavit in support of the nullification bid sighted by Malaysiakini,
Ismail Sabri and the government pointed out that the Agong has properly
exercised his constitutional power to dissolve Parliament upon request
by the caretaker prime minister.
Ismail Sabri and the government
referred to a media statement issued on Oct 10 by Istana Negaraās
Comptroller of the Ro yal Household which stated the Agongās consent to
dissolve the August House.
Vijay47 : Very strange. Why are lawyers from the law firm Hafarizam Wan & Aisha Mubarak acting for the 3 government-respondents? Should that not be the function of the Attorney Generalās Chambers? Never mind, I digress, of course.
Right ab initio (how I love that term!), we are reminded that the reserve squad of lawyers are no better than the First Eleven. The affidavits have Ismail Sabri written all over them, with more than a walk-on role from the legal advisors. You say the matter is now academic, it should be allowed to rest?
That would be akin to saying you cannot sue the doctor now since the patient is already dead. Sheer brilliance.
Ironically, the suit by Charles Santiago has in a way nothing to do with the Agong. It is solely directed to you and company, Ismail Sabri, and nobody else. The issue of the Agongās constitutional power to dissolve Parliament does not arise at all, everybody respects that truth.
But in the cause-and-effect equation, you are alleged to have given His Majesty inappropriate advice in the first place, you are the cause of the predicament we are in. The King, in exercising his royal prerogative, acted in accordance with the application you made, misguided as your submission was.
Of course the Kingās power to dissolve Parliament is non-justiciable. But not the acts of one Ismail Sabri, a commoner from Bera, however much he may assume himself to be of royal heritage.
Mischievously and most disrespectfully, your affidavit-in-support suggests that āthe Yang di-Pertuan Agong has already sought for GE15ā.
His Majesty did no such thing, he is above elections and politics. YOU are the seeker.
So tell me, Ismail Sabri, who is the one being disrespectful to the Agong?
harimau_arif : At the end of the day, itās always the rakyat who ended up holding the short end of the stick. The majority race should wake up and vote correctly in GE15, otherwise, Malaysia is doomed.
Jaybond : You yourself didn't listen to the wanting of raayat and now you drag the Agong into this turmoil.
You started everything by bowing to the court cluster and so hadap and kemaruk to to be elected PM.
Just followed the whim and fancies of a group of people that's been guilty of criminal misdeeds towards the raayat and you as well abetting their wrong doing.
You failed miserably. Shame on you IS.
Newday : Lots of stuff about the Agong in the striking out bid, but very little of the decision by essentially UMNO leading up to the request for dissolution. I hope Charles suit is not struck out.
JazliSalleh : The question is not whether the Agong agreed. The question is whether you as the PM got the approval of the cabinet to advice the Agong to dissolve Parliament.
If the first step is wrong then there is no point talking about the subsequent issues of whether Agong agreed to your advice. Simple logical steps should be followed. That is why a good education Foundation is important. If not the country would be led to chaos like Najib.
