Dr Raman Letchumanan : This seems to be a cockeyed interpretation of law by the government to protect themselves from any abuse by themselves.
Audio-visual evidence is very important and damning as court evidence, it usually trumps oral evidence. If the enforcement authorities say they are 100% followers of the law, why are they afraid of video and audio recording which is used by everyone for the own safety, against criminals and even rogue enforcement officers.
The government as a matter of policy has already agreed that enforcement officers are to be body fitted with cameras for their own safety, to record evidence for court proceedings and of course to help apprehend criminals. The only issue is the delay in procuring the cameras, which in itself is unexplainable and self-serving.
The rakyat can easily and cheaply obtain such ubiquitous devices. Shouldn't the government be happy that the rakyat are helping them to obtain those devices, which the police have been waiting for so long, and seems so elusive to procure. So why this threat of criminal action under the law. The rakyat can only record what is in the public view, not raids or clandestine activities secretly carried out by the enforcement officers.
The enforcement authorities' job is only to investigate according to the law, not interprete what the law should be. It up to the AG and the Courts to interpret the law. Will the AG make a public statement on this matter.
Obstruction of public officers on duty cannot be interpreted as criminality on someone using his mobile phone in public for what it is made for. Lately we have seen many cases brought to justice because of such videos emerging in public. The funny case of the crackhouse comedy club would not have arisen if there was no recording, for example.
Is the government helping to prevent and solve crimes or perpetuating it. Because of these recording devices, crime rate has gone down.
How can any police complaints be made if not backed by audio-video recordings, but just heresay. Criminals will be elated based on this interpretation of the law. Is the government really "berpisah tidak dengan masyarakat" or dengan penjenayah?
Malaysiakini : PARLIAMENT | The Home Ministry has
maintained that it is wrong for the public to record or live stream
police carrying out arrests or raids, adding that body cameras for
on-duty use have yet to be procured.
In a written reply to Lim Lip
Eng (Pakatan Harapan-Kepong) last Thursday, the ministry said filming
an arrest or raid can have action taken against them for obstructing a
public officer in carrying out their duties and disrupting
investigations.
Police had in 2020 said such actions were an offence under Section 186 of the Penal Code for obstructing a public servant in discharge of his or her public functions. That year, police arrested former Universiti Malaya Association of New Youth president Wong Yan Ke for recording a police search.
