Spanish courts have been forced to release a triple child killer, serial
rapists and Basque terrorists from prison early after the European
Court of Human Rights (ECHR) overruled a Spanish legal doctrine that had
effectively prolonged their sentences. Victims groups are protesting at the "betrayal of justice" imposed by
judges in Strasbourg, and authorities have expressed concerns that some
of those convicts freed within the past month pose a danger to society. Angel Juanes, who is chief justice of Spain's high court, has warned
that the release of so many prisoners would create "social alarm" but both the government and judicial authorities say they are powerless to act against the ECHR's ruling. About 200,000 people attended a demonstration in Madrid against the ECHR
ruling organised by the Spanish Association of Terrorist Victims at the
weekend. "We think that justice has not been rendered. We feel very
wounded, very angry," said Angeles Pedraza, the head of the victims'
group. Alberto Ruiz-Gallardon, Spain's justice minister, also spoke of his
"regret" at the European ruling but said it would be up to the Spanish
courts to decide how it applied to other cases. David Cameron has called for reforms of the court and warned that
Britain may have to withdraw from the European Convention on Human
Rights after a series of unpopular rulings that have allowed dozens of foreign criminals – including terrorists –
to remain in the country.
